bnr.bg: Lawyers are at different opinions as concerns the February Report of the European Commission

“Accurate and careful” is the report of the European Commission according to Mrs. Anelia Mingova speaking on behalf of the Supreme Judicial Council, the text of the report is particularly critical towards the work of the SJC. The SJC indicated its intention to meet with representatives from the non-governmental organizations and the Ministry of Justice and to discuss and assess the current need for legislative amendments. Mrs. Mingova abstained from any forecasts on the contents of the next July report of the EC, but stated that regardless of whether it is negative or positive, the problems in the judiciary will not end because “what society expects is always more than what the institutions do”
The critics in the report were also discussed by Mrs. Kapka Kostova who said that the participation of the prosecution in investigations has to be much more intense and serious. We may not expect from  investigating policemen to be that much aware of all the aspects of investigation.
Mrs Bilyana Gyaurova commented that she doesn’t think the monitoring should cease. The report is clear that the necessary changes have not yet been done. She thinks the main problem is in the lack of transparency and objectivity in the selection of the chairpersons of courts. “The comment of the SJC sounds naive to me. Thus, the judiciary is deprived of its active and authoritative leaders.
